I'm working on EAD after applying AC21 to change employer. I was about to send renewal application to USCIS as EAD expires in March 2008 but now I have this update on I-485 and no email from USCIS. I also checked the USCIS automated message calling 1-800 number which also says the same information.

No RFE so far. Like I said all I see is new LUDs and all the online messages on i-485 cases say "case received and pending" on all cases. All cases are at Nebraska.

My case was filed at NSC on august 3rd...transferred to VSC and the 485 was transferred to TSC evn though my 140 is fro NSC...donno the logic behind it though

I previously reported on changes to the H2B visa (http://www.h1b.biz/lawyer-attorney-1137785.html)program. This is a notice on the identification of foreign countries whose nationals are eligible to participate in the H-2A and the H-2B nonimmigrant worker programs. The notice becomes effective when it is published in the Federal Register on 1/18/11.
Under Department of Homeland Security (DHS) regulations, U.S. Citizenship and Immigration Services (USCIS) may approve petitions for H-2A and H-2B nonimmigrant status only for nationals of countries that the Secretary of Homeland Security, with the concurrence of the Secretary of State, has designated by notice published in the Federal Register. I think you can apply for I-140 with a copy. As far as I know, you cannot use premium processing though.

My employer sent all documents to them, I have to go to India on 24th Nov for my marriage, The H1 from my previous employer is valid until Dec 2008. I am planning to come back to US in December last week. Also I have to take appointment in India for my H1 stamping and H4 for my wife.
The application status says, they would respond in 60 days(?????) , for a premium processing ? Can you please advice, what I can do?

However for year 2008, company has requested IRS an extension to file tax return.Company is trying to come up with audited financial statement for year 2008. They are still working on it.
However deadline for filing RFE response is this Wednesday ( 03/11/2009)
My questions:

A colleague and I both filed EB2 PERM labors at around the same time in 2005.
Our 140s got approved roughly together too/
We both also applied for 485 on July 2nd, through the same lawyer, and both applications went to TSC.
Both of us saw our checks get encashed on the same date.
Here's where our applications diverged.
He received an LUD last friday and his EAD card has been ordered.
I received an FP request today(monday) but no LUD updates.
Although our applications are a bit dis-similar (he is married, i filed single), I have this theory that USCIS is splitting their queue, so as to not bombard its internal departments with the flood of work that has recently come in.
It makes total sense to split people into two groups (atleast), and for each:
a) send them EAD cards with a note of FP pending.
b) send them FP notices and do their EAD later.
(I know another friend who is in group a, while I'm in b)
Yes, we all like to bitch and moan about USCIS, but thats generally emo-talk.
So, has anyone else noticed this, or can anyone help me understand what I'm missing here.
This is just me speculating, but I'd like to throw this thought out there and have it rebound with your inputs.

Why is Gary looking outside of USA to tap potential home buyers? Just for folks who aren't aware - there are 500,000 high skilled legal immigrant already in USA who are waiting in queue for numbers of years to get their Permanent Residency. Thanks to the limited visa availability based on country chargeability (birth of applicant) and inefficiency of immigration system, these highly skilled, tax paying and law abiding immgrants are waiting for their Green Card (Permanent residency). Some of them have studied here, worked here for years and US is almost a second home to them. They are sitting on pile of cash, Yes - PILE OF HARD CASH. They wouldn't buy house or any big ticket items until they get Green card. Why not give these people, who are already part of our system, conditional Permanent Residency who buy houses. This will also get us immediately required cash and home inventory will go down as much as 300K at minimum. P.S. I AM TALKING ABOUT HIGH SKILLED LEGAL IMMGRANTS AND NOT ABOUT ILLEGAL IMMIGRANTS.

If your 485 is denied, all derivative benefits like EAD/AP are also lost. You therefore can't use EAD for another job even if 6 months have elapsed.
